1. Introduction

This Terms of Service agreement (“Agreement”) is entered into between Nichols WD LLC (“Service Provider,” “we,” “us”) and you (“Client,” “user,” or “you”). By using our website, services, client portal, communication tools, or any of our digital products, you agree to be bound by these Terms.
This agreement applies to:

  • Web development, branding, and design services
  • Creative and media services (photography, videography, drone work)
  • CRM services including automations, contact forms, appointment scheduling, and marketing campaigns
  • Access to and use of our website or any client dashboard or portal

2. Website & Platform Use

2.1 Eligibility

You must be at least 18 years old and capable of entering into a binding legal agreement.

2.2 Permitted Use

You may only use our platforms for lawful purposes and in accordance with these Terms. Unauthorized use of client dashboards, CRM tools, calendar systems, or automated messaging systems is strictly prohibited.

2.3 Intellectual Property

All materials including text, logos, designs, code, photos, videos, and training content remain the intellectual property of Nichols WD LLC unless otherwise stated. You may not use, copy, resell, or publish our work without explicit written permission.

3. Client Portals & CRM Use

3.1 User Accounts

Client dashboards or portals may be created for your business under our CRM system. By using these tools, you agree:

  • Not to share login credentials
  • To keep your contact and business data accurate
  • To follow all relevant data protection and marketing laws

3.2 CRM System Tools

Services may include:

  • Automated workflows, email and SMS campaigns
  • Calendar scheduling
  • Forms and pipelines for lead management
  • Secure document sharing

Nichols WD is not responsible for:

  • Improper use or misconfiguration of automation rules
  • Errors due to inaccurate contact data
  • Legal consequences of unlawful outbound messaging initiated by the Client

4. SMS & Email Marketing Compliance

4.1 Consent to Communicate

By engaging our services, filling out a form, joining a list, or becoming a customer, you expressly agree to receive communications by email and SMS, including:

  • Appointment reminders
  • Service updates
  • Marketing offers (if opted in)

4.2 SMS Terms

  • Message and data rates may apply
  • Frequency varies by engagement
  • You may reply STOP at any time to unsubscribe from texts
  • You may reply HELP for assistance
  • You may also email us directly at [email protected] to opt out

4.3 TCPA, CTIA, and CAN-SPAM Compliance

We only send SMS and email messages to users who have opted in through clear, affirmative action. We honor all opt-out requests within a reasonable time. We do not sell, lease, or share your contact information for third-party marketing. You are responsible for ensuring your use of CRM tools complies with all applicable marketing and communication laws.

4.4 Carriers

Carriers are not liable for delayed or undelivered messages.
